Guinea Council Condemns Gaming Regulator Tax Instruction Letter

Guinea’s National Transitional Council publicly condemned a letter from the Director General of the Gaming and Related Practices Regulatory Authority, describing it as inadmissible. The letter dated February 4, 2025, instructed gambling operators not to pay legally mandated taxes. The directive triggered strong backlash from the country’s legislative body in November 2025.

Legislative Body Challenges Regulatory Authority

The CNT acts as Guinea’s temporary legislative body during the transitional period, reviewing laws and overseeing government agencies. During 2025 supplementary budget law review, the CNT emphasized application of two levy categories under Initial Finance Law 2025. These include a 15% tax on gross gaming revenue and 7% levy on Non-Commercial Profits for winnings exceeding $90.

The Council claims ARSJPA instructed operators to refuse paying legally established taxes. CNT stated an administrative service opposed application of a law proposed by Government, adopted by Parliament and promulgated by the President without legal basis. The Council described ARSJPA’s actions as contravening the principle of hierarchy of norms.

Legal Status Conflict Requires Resolution

CNT called on the Prime Minister to ensure tax measures are implemented according to Finance Law. The Council highlighted legal inconsistency concerning ARSJPA’s status. Law 08 of March 13, 2023, establishes the authority as an Independent Administrative Authority.

Decree 045 of January 28, 2023, grants it status of a public administrative body, creating conflict between statutory law and executive decree. The CNT recommended repealing the decree and aligning ARSJPA’s framework with Law 08. The Council monitors compliance in key sectors including gaming during Guinea’s transitional government period.
