Law Firm Challenges South Africa Gambling Board Interpretation of Court Ruling
Whitesmans Attorneys has expressed concern over recent comments by the National Gambling Board Acting CEO regarding casino-style betting legality. Meanwhile, the board claimed in its 2024/25 Annual Report that South African-licensed bookmakers offering casino-style contingency bets act unlawfully.

Provincial Authority Determines Betting Types
The law firm confirms that residents of every South African province may lawfully place casino-style contingency bets with bookmakers licensed in any province. Therefore, the Supabets/CASA judgment concerned only an exceptional situation applicable to Gauteng-licensed bookmakers. Moreover, the Gauteng Gambling Act restricts bet types to sporting events for Gauteng licensees. Additionally, this limitation does not apply to bookmakers licensed in other provinces under respective provincial laws.
The Supreme Court of Appeal clarified that provincial gambling authorities, not the National Gambling Board, determine permissible bet types. Meanwhile, players in Gauteng may still lawfully place casino-style contingency bets with bookmakers licensed elsewhere in South Africa. Therefore, the Supabets ruling does not make online betting on casino-style games with South African-licensed bookmakers unlawful. Consequently, the legal position differs significantly from the National Gambling Board’s stated interpretation.
Industry Requires Evidence-Based Regulatory Discussion
The comments triggered widespread confusion in media and industry circles regarding legal betting parameters. Meanwhile, the firm emphasizes the importance of informed, evidence-based debate on gambling regulation in South Africa. Additionally, responsible gambling, social responsibility, and problem gambling represent global challenges. Therefore, solutions require balanced, practical, and collaborative approaches across regulatory bodies.
The National Gambling Board’s assertions are described as baseless in law by gambling legal experts. Moreover, provincial gambling boards adopt the correct and lawful position on casino-style betting permissions. Consequently, industry participants require accurate legal guidance to ensure compliance with provincial licensing frameworks. Therefore, the dispute highlights ongoing jurisdictional debates between national and provincial gambling regulatory authorities.
